COVER GIRL QUEEN COLLECTION SWEEPSTAKES

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. "CoverGirl's Celebrate the Queen in You Sweepstakes" is referred to throughout these Official Rules as the "Promotion." The Promotion is open to legal residents of any one (1) of the fifty (50) United States or the District of Columbia (collectively the "U.S."), exclusively, who reside and are physically located in the U.S. and are eighteen (18) years of age or older at time of entry.

Employees, directors and officers of The CW Network, LLC ("The CW"), Noxell Corporation (the "Sponsor"), Warner Bros Entertainment, Inc., and Administering Agency (defined below), or their respective parent companies, subsidiaries, affiliates, distributors, divisions or advertising and promotion agencies associated with the Promotion or prize suppliers for the Promotion (collectively "Promotion Parties") and members of the immediate family or household (whether related or not) of any such employee, officer or director (whether related or not) are not eligible to enter this Promotion. For the purposes of the Promotion, immediate family members are defined as mother, father, in-laws, grandmother, grandfather, brother, sister, children and grandchildren.

All applicable federal, state and local laws and regulations apply. Void where prohibited.

The Promotion begins at 12:00:01 p.m. (PT) on Monday, December 11, 2006, and ends at 11:59:59 a.m. (PT) on Monday, January 8, 2007 (the "Promotion Period"). Entries received before and/or after the Promotion Period will be void.

ENTER IN THE FOLLOWING WAY: Participants may enter the Promotion online only. Only one (1) entry, per person, per day. A "day" for the purpose of this Promotion is a twenty-four (24)-hour period that begins at 12:00:01 p.m. Pacific Time ("PT") and ends at 11:59:59 a.m. (PT).

The Promotion begins at 12:00:01 p.m. (PT) on Monday, December 11, 2006, and ends at 11:59:59 a.m. (PT) on Monday, January 8, 2007 (the "Promotion Period"). Entries received before and/or after the Promotion Period will be void.

The CW will be the official timekeeper for the Promotion.

To Enter the Promotion:

  • Online:Access "CoverGirl's Celebrate the Queen in You Sweepstakes" on the World Wide Web at http://www.CWtv.com/CWH. Follow the on-screen instructions to reach the Promotion registration page. On the registration page and in the spaces provided, enter the following information: your first name, last name, street address (no P.O. boxes allowed), city, state, zip code, e-mail address and date of birth.

  • Each participant entering the Sweepstakes must also, in the space provided, type in their full legal name as their signature. By providing this signature and by clicking on the "Submit" button, each participant forwards his/her entry into the Promotion, agrees to these Official Rules and accepts The CW's Privacy Policy.


Submission of false or misleading personal information by a participant will be grounds for disqualification of entry. Entries generated by a script, macro or other automated means will be disqualified. Illegible or incomplete entries, as determined by The CW or Administering Agency, at their sole discretion, will be disqualified. All entries and their content become the sole property of The CW and will not be returned or acknowledged. The CW and/or Administering Agency will not deem proof of submission of an entry as proof of receipt of an entry.

WINNER SELECTION / ODDS:

The Administering Agency will conduct a random draw on, or about, Friday, January 19, 2007, from all entries received. If your entry is randomly drawn and it meets the Promotion's eligibility criteria, you could be eligible to win a prize (subject to The CW's verification process). If a potential prizewinner is found ineligible or fails to comply with these Official Rules, that individual's claim to a prize is forfeited and an alternate randomly drawn eligible entry will be contacted. Odds of winning a prize are determined by total number of eligible entries received by Promotion end date.

All prizes legitimately claimed will be awarded.

In the event of a dispute regarding the identity of an entrant, the entry will be deemed submitted by the authorized account holder of the e-mail address provided. An authorized account holder is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization that is responsible for assigning e-mail addresses for the domain name associated with the submitted e-mail address.

Prizes: One weekly grand prize per week for two (2) weeks will be awarded the Weekly Grand Prize. Each Weekly Grand Prize consists of Ten Thousand Dollars ($10,000). Total value of all Weekly Grand Prizes is Twenty Thousand Dollars ($20,000).

Total approximate retail value ("ARV") of all prizes in this Promotion: $15,500. Prizes will be awarded to the winners selected in accordance with the "Winner Selection/Odds" section above.

A total of one hundred (100) First Prizes will be awarded: Each prize consists of a Queen Collection T-shirt, a Queen Collection makeup bag, and a selection of Queen Collection makeup products. Approximate retail value ("ARV") of each individual prize: $35.00.

One (1) Grand Prize will be awarded: Grand Prize winner will receive a three (3)-day/two (2)-night trip for the Grand Prize winner and two (2) travel companions to New York City for a "CoverGirl" makeover experience (the "Event"). Travel dates are tentatively scheduled sometime between January 2, 2007, and April 30, 2007, and Grand Prize winner must travel on The CW-selected dates or the prize will be forfeited.

The trip portion of the Grand Prize includes only the following:


  • Round-trip economy airfare for Grand Prize winner and two (2) travel companions (travel companions must be eighteen [18] years of age or older at time of initial contact by Administering Agency) from a gateway airport near Grand Prize winner's residence (final determination of the departure airport is at the sole discretion of the Administering Agency) to the actual destination city airport (final determination of the destination city and airport is at the sole discretion of the Administering Agency) [if the Grand Prize winner lives within a one-hundred-and-forty-five (145)-mile radius of the event, he/she may not be eligible for air transportation; in that event, and at The Administering Agency's sole discretion, ground transportation or a transportation allowance may be provided in lieu of air travel and the difference in value, if any, between the air travel and ground transportation or transportation allowance will not be awarded].
  • Round-trip destination ground transportation from airport to hotel (airport�hotel�airport). Mode of transportation TBD by the Administering Agency (if Grand Prize winner is not eligible for air transportation, round-trip destination ground transportation is not necessary and will not be awarded).
  • Two (2) nights' hotel accommodations of Administering Agency's choice (one [1] room, deluxe suite, triple occupancy, room and tax only).
  • Round-trip Event transportation (transportation from the hotel to the Event and back to the hotel). Mode of Event transportation TBD by Administering Agency.
  • A "Makeover Session" by Celebrity Makeup Artist Roxanna Floyd (the "Artist") for the winner and both travel companions consisting of application of CoverGirl brand makeup. Location of Makeover and product used are at the sole discretion of the Artist.

ARV of Grand Prize: $12,000.00. Actual ARV will be based on Grand Prize winner's city of origin and actual destination city. Grand Prize winner will be issued an IRS form 1099 for the Grand Prize based on the actual ARV.

Grand Prize winner and travel companions must travel together during the specific travel dates. If the Grand Prize winner cannot travel during the specified travel dates, then he/she forfeits the entire Grand Prize and an alternate randomly drawn eligible entry will be contacted. The Promotion Parties are not responsible for the cancellation of the Event. If Event is cancelled during the travel dates, Grand Prize may become a trip to New York City, as described above, without the Event and Event-related amenities.

Grand Prize does not include transportation to and from Grand Prize winner's departure airport, meals, beverages, taxes other than the room tax, gratuities, incidentals, in-room charges, telephone calls, and/or any other expenses not specified in these Official Rules. All of the expenses mentioned in the previous sentence are the sole responsibility of the Grand Prize winner and travel companions. Promotion Parties are not liable for any expenses incurred as a consequence of flight cancellation/delay. Travel is subject to airline and accommodation restrictions, blackout dates and availability. Final choice of departure and destination airports, airline carrier, flight times and/or destination accommodations is at the sole discretion of the Administering Agency. The Grand Prize winner may be required to provide a credit card at the time of accommodations check-in. Certain documentation will be required for travel, such as photo identification, all of which is Grand Prize winner's and his/her travel companions' sole responsibility. No credit or cash will be given for any unused portion of the Grand Prize. No trip extensions or changes will be made unless the Sponsor or The CW so imposes.

Grand Prize winner and travel companions must abide by, and are subject to, any and all minimum/maximum height, weight and health-related requirements or restrictions set forth by the airline carrier and/or service providers. Grand Prize winner and travel companions are responsible for obtaining any insurance (including, but not limited to, any travel and health insurance).

By entering this Promotion and accepting a Grand Prize, Grand Prize winner and travel companions agree that Sponsor, The CW and the Administering Agency reserve the right to disqualify and remove the Grand Prize winner and/or travel companions from any activity at any time if the Grand Prize winner's and/or travel companions' actions at any point may or do cause damage to person, property or the reputation of any of the Promotion Parties.

GRAND PRIZE WINNER NOTIFICATION PROCESS:

The tentative Grand Prize winner will be notified by telephone and/or e-mail. If he/she cannot be reached within five (5) business days from the date of first notification attempt, such person will be disqualified and an alternate entry will be randomly drawn.

Once Administering Agency has received verbal confirmation from the tentative Grand Prize winner of his or her desire to accept the Grand Prize (subject to verification of eligibility), tentative Grand Prize winner will receive a Grand Prize Winner Affidavit of Eligibility/Release of Liability and two (2) Travel Companion Release of Liability Affidavits ("Affidavits") via mail or other courier service. Grand Prize winner may be required to provide a valid Social Security number for tax purposes.

All Affidavits must be completed, notarized and returned to the Administering Agency (L.A. Promo, 206 N. Signal Street, Suite P, Ojai, CA 93023) within seven (7) calendar days of tentative Grand Prize winner's receipt of the Affidavits. A disqualification may result and an alternate entry will be randomly drawn if all Affidavits are not returned to the Administering Agency within the specified time. Refusal or return of any Grand Prize notification or Affidavit as undeliverable will also result in disqualification and an alternate entry will be randomly drawn.

FIRST PRIZE WINNER NOTIFICATION PROCESS:

First Prize winners may receive their prizes by mail or other courier service with no prior notice. At its sole discretion, the Administering Agency may require a tentative First Prize winner to execute an Affidavit of Eligibility, Liability Release and Publicity Release (collectively, "Affidavit/Release"). If Administering Agency chooses to notify a tentative First Prize winner rather than sending the prize by mail or other courier service, with no prior notice, and that tentative First Prize winner cannot be reached within three (3) calendar days from the date of first notification attempt, such person will be disqualified and an alternate entry will be randomly drawn.

If required, Affidavit/Release must be returned to the Administering Agency (L.A. Promo, 206 N. Signal Street, Suite P, Ojai, CA 93023) within five (5) business days of receipt of the Affidavit/Release. A disqualification will result and an alternate entry will be randomly drawn if the Affidavit/Release is not returned to the Administering Agency within the specified time.

Refusal or return of any prize notification, Affidavit/Release or prize as undeliverable will result in disqualification and an alternate entry will be randomly drawn.

ADDITIONAL PRIZE INFORMATION / TAXES: There is no substitution for any prize or any portion thereof, except due to unavailability, in which case a prize of equal or greater value will be awarded at the sole discretion of the Administering Agency, The CW and/or Sponsor. Prizes are not transferable, assignable or redeemable for cash, except at The CW �s sole discretion. Prizewinners are solely responsible for any and all federal, state and local taxes on prize value.

PRIVACY STATEMENT:

Specific to the Promotion, a participant's personal information will be utilized by the Administering Agency for selecting the winners, fulfillment of Promotion prize and to comply with legal requirements. Specific to the Sponsor a participant's personal information may be utilized by the Sponsor for the purpose of contacting them in the future via email regarding new products, special offers or Sponsor-specific general information. PUBLICITY GRANT:

Except where prohibited by law or The CW's Privacy Policy, by entering the Promotion, each participant grants the Promotion Parties the perpetual and irrevocable right and license to use his/her name, photograph, visual and audio likeness, statements, biographical information, address and any other information contained in his/her entry on a worldwide basis, for commercial and other purposes, and in all forms of media now known or hereafter devised, in perpetuity, without further compensation, review or approval.

NO WARRANTIES:

PRIZE IS PROVIDED "AS IS" AND "WITH ALL FAULTS." PROMOTION PARTIES MAKE NO WARRANTIES, EXPRESS OR IMPLIED, IN FACT OR IN LAW, RELATIVE TO THE USE OR ENJOYMENT OF ANY PRIZE, OR ANY PORTION THEREOF, INCLUDING, WITHOUT LIMITATION, ITS QUALITY, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. ANY AND ALL WARRANTIES FOR A PRIZE, OR ANY PORTION THEREOF, ARE CONTAINED IN THE MANUFACTURER'S OR SERVICE PROVIDER'S WARRANTY, AS RELEVANT.

RELEASE, HOLD HARMLESS AND INDEMNIFICATION: BY ENTERING, PARTICIPANTS RELEASE AND AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS THE SPONSOR, THE CW AND ALL PROMOTION PARTIES INVOLVED IN THIS PROMOTION FROM AND AGAINST ANY AND ALL CLAIMS, DEMANDS, LOSSES AND CAUSES OF ACTION FOR ANY DAMAGES (INCLUDING, WITHOUT LIMITATION, ALL CONSEQUENTIAL, ECONOMIC AND INCIDENTAL DAMAGES), LIABILITY, LOSS, COST, FEES (INCLUDING ATTORNEYS' FEES), INCLUDING, WITHOUT LIMITATION, DAMAGE TO PERSON (INCLUDING DEATH) OR PERSONAL OR REAL PROPERTY, DUE IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, BY REASON OF THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF ANY PRIZE (INCLUDING ANY ACTIVITY OR TRAVEL RELATED THERETO) OR PARTICIPATION IN THE PROMOTION AND WHETHER OR NOT CAUSED, IN WHOLE OR IN PART, BY THE ACTS, OMISSIONS, NEGLIGENCE OR MISCONDUCT OF THE PROMOTION PARTIES.

DISCLAIMERS / LIMITATIONS ON LIABILITY:

BY ENTERING, EACH PARTICIPANT AGREES THAT THE PROMOTION PARTIES ASSUME NO LIABILITY WHATSOEVER FOR INJURIES OR DAMAGES OF ANY KIND SUSTAINED IN CONNECTION WITH THE USE, ACCEPTANCE, POSSESSION OR AWARDING OF ANY PRIZE OR WHILE PREPARING FOR, PARTICIPATING IN AND/OR TRAVELING TO OR FROM ANY PROMOTION-RELATED ACTIVITY, INCLUDING, WITHOUT LIMITATION, ANY INJURY, DAMAGE, DEATH, LOSS OR ACCIDENT TO PERSON OR PROPERTY DUE TO AN INTENTIONAL ACT, AN ACT OF NEGLIGENCE OR DEFAULT AND/OR ANY ACT OF GOD.

PARTICIPANTS AGREE THAT THE PROMOTION PARTIES ACCEPT NO RESPONSIBILITY FOR ANY EXPENSES, OMISSIONS, DELAYS, RE-ROUTING, OR ACTS OF ANY GOVERNMENT OR AUTHORITY. WINNER ACKNOWLEDGES THAT HE/SHE IS SOLELY RESPONSIBLE FOR ANY ACTIONS, CLAIMS OR LIABILITIES RELATED TO ANY PROMOTION ACTIVITY.

The Promotion Parties are not responsible for any damaged, delayed, illegible, incomplete, late, lost, misaddressed, misdirected, mutilated, postage-due or stolen mail. In addition, Promotion Parties are not responsible for any typographical errors in these Official Rules, Promotion content or any advertising materials for the Promotion, or for any kind of computer, electronic, hardware, software, Internet, network, technical or telephone failures and/or problems caused by the Promotion Parties or the user, or by any of the equipment or programming associated with or utilized in the Promotion, or by any human error that may occur in receiving and/or processing of the entries in the Promotion, or by infection by computer viruses, bugs, tampering, unauthorized intervention, fraud or technical failure.

If the Promotion becomes compromised, hampered, interrupted, not capable of running as planned, rendered impossible of performance in any way or prevented, including, without limitation, because of any kind of computer viruses, bugs, electronic, hardware, software, Internet, network, technical or telephone failures, tampering, unauthorized intervention, fraud, an event of force majeure or any other cause created by Promotion Parties, the user or by any of the equipment or programming associated with or utilized in the Promotion, The CW reserves the right, at its sole discretion, to change the Official Rules, to cancel, modify, suspend or withdraw the Promotion or any Promotion offer and/or cancel, modify, suspend or withdraw any method of entry, without notice, and select winners from all entries received for the Promotion prior to or after the cancellation, modification, suspension or withdrawal. As used herein, an event of force majeure shall be deemed to include, without limitation, an act of God; an act of terrorism, war, riot or civil commotion; fire; casualties; boycott; labor dispute, strike or stoppage (including a strike by the members of any union); an act of any federal, state or local authority; or any other similar or dissimilar act beyond the Sponsor's, The CW's or Administering Agency's control.

GENERAL CONDITIONS OF ENTRY:

All participants, as a condition of entry, agree that they have not purchased any kind of Internet service whatsoever in order to participate in and/or enter the Promotion. Participants agree not to knowingly damage or cause interruption of the Promotion and/or prevent others from utilizing the Promotion. CAUTION: ANY ATTEMPT TO DAMAGE ANY ONLINE SERVICE OR WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION OR CAMPAIGN VIOLATES CRIMINAL OR CIVIL LAWS. IF SUCH AN ATTEMPT IS MADE, THE CW AND/OR ADMINISTERING AGENCY MAY, AT THEIR SOLE AND REASONABLE DISCRETION, DISQUALIFY ANY PARTICIPANTS MAKING SUCH ATTEMPT AND THE CW MAY SEEK DAMAGES (INCLUDING ATTORNEYS' FEES) TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION.

GOVERNING LAW AND VENUE: The parties agree that the Promotion and these Official Rules will be governed, construed and interpreted under the laws of the state of California. Each participant and their parent/legal guardian agree that any or all lawsuits brought by participants or their parents or legal guardians pursuant to these Official Rules or the Promotion will be brought in the courts of the state of California.
